DUI Mailbag: If I Lose My License, I Lose My Job

Every Friday we will take a look at some of the most commonly asked questions about Pennsylvania DUI so that we can clear up any misconceptions and provide you with the most up-to-date and accurate information.  Today:

I am a manufacturing sales rep in Central PA and have spent the last 10 years building up my accounts and status.  I was recently arrested in Harrisburg for my second DUI in the last 5 years.  If I lose my license I can pretty much kiss all of my success good-bye.  What should I do?

Normally, if convicted, a second Pennsylvania DUI carries the following mandatory minimums:

  • 5-90 days in prison and between 6months supervision to 60 months supervision
  • 12-18 month license suspension
  • $300-$5000 fine

Pennsylvania Drivers License Can be Suspended due to DUI My first recommendation to you is hire the best DUI lawyer you can find.  There are many successful approaches to defending DUI cases and an experienced DUI expert attorney can review the particular details of your case and determine the best course of action.  For example, the cause of the stop needs to be examined closely because if the officer did not have probable cause to stop your vehicle, the stop may be deemed unconstitutional and nullify any evidence gathered.  The records for the breath machine need to be examined to make sure it was producing accurate readings.  The video of the Standardized Field Sobriety Tests (SFSTs) need to be examined because there are certain procedures and protocols the police need to follow in order for those tests to be valid.  The laboratory procedures at the police crime lab need to be examined in the case of blood testing because improper handling and improper analysis can contaminate the blood samples and lead to invalid results.
