If I got a DUI in 1992 and the law was passed on june 4, 2010, does that dui stay now? If i get one in the future would that be my first or second offense? Since prior to 2010 it only stayed on your license for 10 years.
Great question. While we seem to believe that this change in the “look back period” from 7 years (under 3731) to now 10 years (under 3802) would meet the classic definition of an ex post facto law, the appellate courts says it does not. It is a 10 year look back period that goes from conviction to offense date.

My boyfriend’s work is looking to send him to Canada for a few months. He was charged with a first offense DUI in 2008. However, he participated in and completed the Pennsylvania ARD program and the criminal DUI charges were dropped. If he is flying to Canada for work and staying 3-4 months, will he be detained and denied entry at the airport because of his DUI charge even though it’s not on his criminal record, but is on his driving record?
In PA how long does the state (or lab) have to keep the blood that they used to test your BAC? How long do they have to keep the 2nd vial that was drawn?
